This agreement outlines the Terms of Use set forth by Windy Indigo Farm and Fiber LLC (“We”) for use of the Windy Indigo Farm and Fiber website and Membership (“The Shed”) by the user or Member (“You”).

1. Terms

By accessing this website and/or Membership, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you do not agree with any of these terms, do not use or access this site.

The materials contained in this website and Membership are protected by applicable copyright and trademark law.

2. Governing Law and Venue

This Agreement and any issue or dispute arising out of or otherwise related to this Agreement or with your access or use of the Website, our Privacy Policy, Affiliate Policy, or Return/Exchange policy, or any matter concerning Windy Indigo Farm and Fiber LLC, including your purchase and use or attempted use of any service of product shall be governed exclusively by the laws of the State of Washington.

Any Claim or dispute that is not resolved by arbitration shall be exclusively brought in and decided by the state or federal courts located in Seattle, Washington, and you hereby irrevocably consent to the exclusive personal jurisdiction of, and exclusive venue in, such courts and forever waive any challenge to said courts’ exclusive jurisdiction or venue.

3. Privacy and Your Personal Information

We respect your privacy and the use and protection of your non-public, personal information. Your submission of personal information through the Website, online store, and membership is governed by our Privacy Policy.

Windy Indigo Farm and Fiber LLC reserves the right to modify its Privacy Policy at its reasonable discretion from time to time. Our privacy policy is incorporated into this agreement by reference.

4. Purchase and Payment

If you wish to purchase any product or service made available through our Website, you may be asked to supply certain information including, without limitation, your name, your credit card number, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct, and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

All purchases and payment plans will be billed in U.S. dollars (USD). Windy Indigo Farm and Fiber LLC is not responsible for international purchase fees or exchange rates.

Following successful purchase of a physical product, you will receive an order confirmation within 24 hours. Upon shipping, you will receive notification of the shipment tracking information at the email address associated with your order.

Following successful subscription to the Membership, you will receive relevant welcome and access information within 24 hours. Membership will auto-renew on a quarterly (every 3 months) or annual (every 12 months) basis, as determined at the time of purchase. You may request a change to your billing schedule at any time, and changes will become effective at the time of the next billing cycle.

5. Restrictions

Windy Indigo Farm and Fiber LLC is located Washington State, USA, and operates in the Pacific Time (UTC-8:00). Live content will most often be produced during daytime hours in the governing time zone.

Membership allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos or other material (“Content”). You are solely responsible for the Content that you post on or through the Membership, including its legality, reliability and appropriateness.

By posting Content on or through the Membership, you agree that the Content is yours and/or you have the right to use it; and (ii) that the posting of your Content on or through the Membership does not violate the privacy rights, copyrights, or any other rights of any person or entity.

We reserve the right but not the obligation to monitor and edit all Content provided by users.

You agree that you will not:

• Share your login information with non-members
• Reproduce any of the information received as part of your membership and share it with non-members
• Post inappropriate, inaccurate or offensive content to forums or discussions
• Harass or in any way intrude upon any other member

We reserve the right to terminate the account of any person found to be in violation of this policy.

6. Liability

You understand that there are inherent risks in participating in activities online.

In no event shall Windy Indigo Farm and Fiber LLC or any of its officers, employees, or partners be liable for any tangible or intangible damage arising from or related to this Agreement, your use or attempted use of the Website, Membership, or any product. This includes without limitation any loss of use, loss of profits, loss of data, loss of goodwill, cost of procurement of substitute services or products, or any other damages.

You agree that Windy Indigo Farm and Fiber LLC cannot guarantee any results of participation in the Membership. Any negative or positive results that might occur during participation in the Membership are the result of your own personal choices.

7. Intellectual Property Rights

Windy Indigo Farm and Fiber LLC and its original content, features and functionality will remain the exclusive property of Windy Indigo Farm and Fiber LLC and is protected by copyright, trademark and other laws of the United States and foreign countries.

8. Cancellations and Refunds

You may cancel your Membership at any time, for any reason, prior to the next billing cycle and you will not be billed for the next billing cycle.

Unused physical product may be returned within 30 days of purchase for a full refund. Please ship product to the following address:

You are responsible for all shipping costs. Refund will be remitted upon receipt of the product. Please provide shipment tracking information to TheShepherd@windyindigo.com.

Any service involving my time is not eligible for refund.

9. Termination

Windy Indigo Farm and Fiber LLC reserves the right to terminate or suspend your account at any time with or without refund, cancellation of the payment plan, notice, or liability under our sole discretion, for any reason whatsoever and without limitation.  

Reasons for termination include but are not limited to:  

• Breach of these Terms and Conditions;
• Abusive or inappropriate behavior to any member of the Windy Indigo’s team;
• Abusive or inappropriate behavior toward other members in online meetings, in-person meet-ups or membership forums;
• Non-payment of Membership fees;
• Product or service availability;
• Errors in the description or price of the product;
• Error in your order.

You further agree that Windy Indigo Farm and Fiber LLC shall not be liable to you or to any third party for the consequences of such termination or suspension. Termination will be effective without notice. Upon termination, you must promptly destroy all copies of any aspect of the Website or Membership in your possession.

10. Revisions

Windy Indigo Farm and Fiber LLC reserves the right, but does not commit, to make changes to the materials on the Website and in the Membership at any time without notice.
